Breaking Updates: Latest Agency Guidance Regarding Shutdown

(THE JANUARY 2018 SHUTDOWN HAS ENDED AS OF MONDAY, JANUARY 22)
Below is a running list of shutdown-related guidance that has been received by CU Boulder. When possible, we are sharing a link to the source. In some cases, the guidance was received via official emails or similar correspondence. In those cases, we will share the content and describe its source.

Due to the lapse in government funding, National Science Foundation websites and business applications, including NSF.gov, FastLane, and Research.gov will be unavailable until further notice. We sincerely regret this inconvenience. 

Updates regarding government operating status and resumption of normal O&M can be found at www.opm.gov.

In cases of imminent threat to life or property, please call the Office of the Inspector General at 1-800-428-2189.

As of January 20, 2018 there is no longer appropriated funding for Federal Agencies, including NASA.  As a result, the Goddard Space Flight Center installation will be forced to shut down on January 22, 2018 with limited exceptions for specific activities, unless additional appropriated funds are received by the Agency.   To the extent this this contract involves work being performed off-site from a government installation, and does not require any civil servant oversight or other government support, such work shall continue as long as funds remain available for performance.  The “limitation of funds” clause in your contract will determine how long that work can continue.  You are reminded that the date shown in the contract for funding coverage for this work is only an estimated date.  Funds could actually be exhausted prior to that date or may cover performance beyond that date. You are encouraged to closely manage the available funding as additional funding will not be provided while the Agency is without appropriations. You are cautioned to carefully plan the work to be performed as Government oversight and administrative personnel (e.g. quality inspectors) will not be available to support your ongoing activities.  Once Federal appropriations again become available, the NASA installation will reopen and funds can be added to your contract as deemed necessary and Government oversight and administrative personnel will resume their ordinary duties.

In addition, deliveries will not be accepted at NASA facilities during the shutdown; delivery trucks will be denied access at the gate, unless specifically authorized for excepted work.

Subject: SAMHSA Informal Notice to Financial Assistance Recipients

Dear Financial Assistance Recipient,

This is to advise the Department of Health and Human Services (HHS) financial assistance recipient community of the HHS plans regarding actions that may be necessary in the event financial assistance award funding is affected by a lapse in appropriations.

Based on the prospect of a lapse of funding and the lack of a continuing resolution, HHS is acting in a prudent manner and notifying recipients of a potential lapse in the funds designated for your award.  As a consequence of the lapse, certain planned awards may be cancelled or postponed, and certain existing awards may be stopped, reduced in scope, terminated, or partially terminated.

Should HHS determine that any of these actions are necessary, the financial assistance officer for each of the affected programs or awards will provide prompt appropriate notice to the recipient in accordance with the terms and conditions of the award.  Notices will contain the direction necessary to comply.

If an award will not be affected by the lapse in appropriations, HHS does not plan to provide any separate notifications or communications of that fact.  Unless a recipient is provided a formal notification to the contrary, all HHS recipients must continue to comply with all terms, conditions, requirements, and performance goals specified in their financial assistance award.

SUBJECT: Grantee Performance and a Lapse in Appropriations 

Should a lapse in federal appropriations occur, the National Oceanic and Atmospheric Administration (NOAA), a bureau of the U.S. Department of Commerce, will limit operations. 
The Grants Online System will not be available. As a result of limited federal operations, recipients who are paid on a reimbursable basis will be unable to receive payment during a lapse in appropriations. 

Generally, grants that were funded and do not require access to Government facilities, active administration by Government personnel or the use of government resources in a manner that 
would cause the government to incur additional obligations during the lapse may continue performance. The Automatic Standard Application for Payment (ASAP) system is anticipated to be operational during a lapse in appropriations. NOAA grantees and cooperative agreement holders with existing awards are authorized to continue to perform and have access to and be able to draw down funds through the ASAP.

Dear OJP Award Recipient –

The current Continuing Resolution to fund Federal government operations expires at midnight (EST) on Friday, January 19, 2018. Without another Continuing Resolution or enactment of FY 2018 full-year appropriations, there will be a funding lapse that would result in cessation of many federal agency services. 

However, should there be a lapse (“government shutdown”), the Office of Justice Programs (OJP) has sufficient resources to remain operational through 5:00 p.m. (EST) on Friday, January 26, 2018. This means that OJP staff will be available to assist grantees, stakeholders, and the public during this period.  Likewise, OJP systems and services will be available.  Please note that the Grants Payment Request System will remain in service to accept grant payment requests.  However, at this time, the Department is still determining whether Department staff will be available to process the requests.  We will provide an update on Monday on the status of grant payments. 

If it appears that a lapse in FY 2018 appropriations will continue beyond January 26th, we will contact you regarding OJP’s operational status and any potential impact on our services and systems.
